In a personal injury case, a plaintiff receives compensation for harms and losses actually suffered.  There is no compensation for what could have happened.  I frequently speak with clients who say that they "could have died."  I explain to them that they should be thankful that what could have happened did not happen.  The law provides for compensation only for what actually did happen not for what could have happened.
