IN A DIVORCE CASE, WHAT ARE THE ISSUES ?

Divorce cases seek to end a marriage.  A long time ago, people were required to prove fault in order to obtain a divorce.  That is not the rule today.  Connecticut is a no-fault divorce state.  Thus, you are not required to prove fault in a divorce case.  As a result, anyone can receive a divorce even if the other spouse wants to remain married.

In divorce cases, the parties seek to divide assets.  If child custody is disputed, then that is also decided as part of the case.  In your divorce case, you must share your financial information with the other side.  To do so, you will be required to submit a detailed financial affidavit.  The statement must be sworn true under oath.

Assets such as your family home, real estate, a business, and pensions must all be divided properly. Tax laws, and pension laws must be considered.  As a result, a divorce case is never as simple as dividing your assets in half.  With significant assets at stake, you must seek the help of an experienced divorce and family law lawyer.

WHO WILL DECIDE THE DIVORCE OR FAMILY LAW CASE?

In Connecticut, divorce and family law cases are decided by the judge, and not juries.  In practice, however, many matters are settled through agreement, or mediation instead of a trial.   Therefore, through the use of mediation, and conflict resolution, many disputed issues in a divorce or family law case will be decided by the parties themselves.

Mediation is a way of settling a dispute through the help of a neutral mediator.  They are often less expensive, and less time consuming than the court trial process.  Frequently, they also produce outcomes that satisfy both parties.  As a result, mediation is becoming an increasingly popular way to settle divorce and family law cases.

CHILD CUSTODY, VISITATION, AND CHILD SUPPORT

The legal issue in a child custody case is what is the child’s best interest.  In child custody cases, emotions run high.  As a result, it is sometimes very difficult for parties to reach a compromise.  With a lot at stake, these cases are very difficult for the family.  As a result, it is important to have an experienced divorce and family law attorney at your side.

Divorce, custody, and family law cases end with an order of the Court.  Sometimes the parties reach an agreement to end their case, and other times the case ends with a Court ruling after a trial.  Unfortunately, even in spite of a court order, some people violate the Court order.  When that occurs you can file a post-judgment case seeking to hold the other party in “contempt” of court for failing to follow the prior Court order.  In these cases, you might be able to recover attorneys’ fees as part of your remedy.
