It is very important to avoid even the appearance of exaggeration at a deposition. If you exaggerate you will lose credibility. That is why the task of avoiding exaggeration is a number 1 priority in my office. Once you understand why you must not exaggerate, the you must practice not to do it. Step 1 is--be prepared. Think about exactly how you are injured so you have a clear picture of how you are injured, and think about the best words to accurately explain you injury. You don’t want to give a generalized off the cuff response during your deposition.
