On December 22, 2013, while on a roving DUI patrol, a State Police officer stopped and subsequently arrested Brandon M. Henry under suspicion of operating under the influence of alcohol or drugs and operating a motor vehicle with a suspended license.
After a valid arrest, a police officer is authorized to perform an “inventory” search of the arrestee’s motor vehicle. This is a loophole to the warrant requirement. The inventory search produced a loaded 45-caliber handgun in the glove box and several baggies of marijuana packaged for sale. A criminal history check of the accused determined that he is a convicted felon.
