Defensive medicine is a term used to shift blame away from the real problem with our health care system which is too many expensive tests, procedures, and pills. Defense medicine is not caused by a need to defend against a potential malpractice claim. Instead, it is caused by our medical industrial system that creates a financial incentive to (1) create more expensive drugs (2) invent more expensive machines (3) do more expensive tests. And the entire time drug companies are selling more drugs, and device companies are making more machines to do more and more tests. The root cause in all of this is a pay for service system for medical care instead of pay for results system.
See the recent article in our The Bartinik Law Firm Article library in which we discuss the Johns Hopkins researchers study finding that defensive medicine accounts for 60 time more than the cost of large medical malpractice law suits.
