Q
Who pays my wages when I miss time off from work due to the car crash?

A

Lost wages are part of your damages claim in your personal injury case. So, the defendant is liable for your lost wages when the case is over. But until your case in concluded with either a settlement or a jury verdict in your favor, the defendant is not required to pay you your lost wages. You are left to fend for yourself. If you are lucky enough to have disability insurance, then those payments might kick in. But if you do not have disability insurance, and you are not working, then you will receive no wages. If your injury is serious enough, you might qualify for social security disability. But that process also takes time. Worse, you might be forced to continue working against your doctor’s advice simply to make enough money to pay your bills. That is one of the reasons that you need a lawyer when you are involved in a car crash case. You will need to evaluate not only the personal injury case, but also your rights to disability benefits, and medical leave.
