A lien in a personal injury case, is a right to be paid out of the proceeds of personal injury case. There are many types of liens that exist under the law that can apply to your car accident case. Each type of lien is based on laws and regulations that apply to that particular type of lien. There are many different liens. They do not all operate the same. There are many different rules apply to each one. Examples include liens by private health insurance plans covered by ERISA, Medicare, the Connecticut Department of Administrative Services, the Medical Care Recovery Act, the Department of Correction, Workers Compensation, and Child Support liens. Note that the term lien is used in a general sense, and technically not all claims are liens. But in practice they are treated as liens.
