So, the first order of business is to Get a Copy of the Medical Records.  We can't even speculate about whether their is a viable case without the medical records.  

It is also possible for our potential client to get the medical records on their own even before they contact a lawyer.  Anyone has a right to get their own medical records.  All they will have to do is to fill out and sign and appropriate written medical authorization asking for a copy of the records.  There will probably be a per page fee from the medical provider, but that should not be too large.
