If the at fault driver has no insurance then he is an uninsured driver.   That means they have no liability insurance to pay your claim.  You are left to try to collect from the driver’s personal assets like his house, or bank account.  But if he had no car insurance, he probably does not have very much money in the bank.  If the at fault driver has no insurance, you can make a claim against your own car insurance by making an uninsured motorist claim.  As part of your insurance you have protection from an uninsured driver called uninsured motorist coverage.  Uninsured motorist coverage is very important because it is your only protection against an uninsured driver.
