Retaliation claims just got harder to bring in Southeastern, Connecticut.
The Supreme Court issued a decision this summer that makes retaliation claims harder to bring in employment cases. Essentially, the Court has increased the standard of proof in a Title VII claims to require proof that the retaliation was the "but for" cause of the harm. The prior standard was a standard that allowed the plaintiff to win as long as the retaliation was "part of" the cause of the harm. This decision is bad news for employees.
